Welcome to the Cortex Pro Site (the "Site"). ColSpace owns and operates the Site and offers certain
information, content, products and services through the Site. This Terms of Use document sets forth
certain important legal information concerning the Site and your use of the Site. Persons who
register with ColSpace also will be bound by the terms of a Registration Agreement which is part of
the registration process. ColSpace may update or change this Terms of Use document at any time.
A. Privacy Statement We recognize the importance of online privacy and have created a Privacy
Statement to describe the types of information we can (and cannot) collect at the Site from visitors
to this Site, and how we can use such information. Unless ColSpace has entered into a written
agreement with you that expressly replaces this Privacy Statement, our Privacy Statement describes
the privacy policies that apply to you while you are using this Site. You may view the Privacy

B. Acceptable Use Policy ("AUP") You are prohibited from violating, or attempting to violate, the
security of the Site, or from using the Site for any unlawful purposes (including sending of spam,
and posting information that is obscene, threatening, or infringes another person's intellectual
property rights). Any violations may result in criminal and civil liabilities. ColSpace reserves the
right to suspend or terminate your access to the Site immediately if we determine you may be in
violation of this Policy, and users of this Site agree to indemnify and hold harmless ColSpace from
any losses, damages, costs, or expenses resulting from a violation of this Policy. Users who
register with ColSpace and create a Site Account on this Site will be required to agree to
additional AUP terms within a Site Account Registration Agreement.
C. Software Access is Licensed All ColSpace CortexPro software that can be created and accessed
through the Site (including html code generated by CortexPro software) is copyrighted material, and
access to such software is licensed under ColSpace software access license terms. Persons who
register with ColSpace will be given an opportunity to review and accept such terms.
D. Copyright Violations You are responsible for obtaining (and paying for) access to the Site. Users
of this Site may not post materials at the Site which infringe another party's copyright. Access to
the Site may be denied to persons who violate this provision. If you believe material at this Site
(or linked to directly from this Site) violates a third party copyright, you may notify the ColSpace
Legal Department by sending email to support@colspace.com.
E. Your Rights to Download Data on this Site You recognize that ColSpace cannot and does not
guarantee or warrant that any files available for downloading through the Site will be free of
infection, viruses, worms, Trojan horses or other code that manifests contaminating or destructive
properties. You agrees that you shall be solely responsible for implementing sufficient procedures
to satisfy your particular requirements for accuracy of data input and output, and for maintaining a
means external to the Site for the reconstruction of any lost data. The parties also expressly
recognize that the Internet contains unedited materials, some of which are unlawful, indecent, or
offensive, and access to such materials by you is done at your sole risk.
Certain Documents at this Site may be provided by third parties. Unless expressly stated otherwise
within such third party content, you may copy the third-party Documents as provided above. The
copyright notices of such third parties will be as appears on such Document.
F. Trademarks CortexPro, Empower, FlightPlan, Telepathy, Powered by CortexPro, and all other
ColSpace product and service names and logos are either service marks, trademarks, or registered
trademarks of ColSpace Corporation. All other tradenames, trademarks and service marks are the
properties of their respective owners.
G. We Don't Control the Linked Web sites We have included various links to third-party Web sites
within this Site. Please be aware that we have no control over, and are not responsible for, the
content of such third-party Web sites and can make no representations about any Web site that you
may access through this one. The fact that we provide a link to another Web site is not an
indication of any endorsement or affiliation with or between ColSpace and the third party hosting
such Website.
H. This Site May Contain Errors We work hard to provide you with lots of useful information on this
Site. Despite our efforts, however, this Site may contain technical inaccuracies or typographical
errors. In addition, unless otherwise agreed with you in writing, ColSpace may change, update,
improve, or delete any of the information, products, or services contained in or described in this
Site at any time.
Except as may otherwise be agreed to in writing or in the Registration Agreement, we can make no
representation about the suitability of the information, products or services published on or
available at this Site for any purpose. As such, except as may otherwise be agreed to in writing or
in the Registration Agreement, ALL DOCUMENTS, INFORMATION, PRODUCTS AND SERVICES PROVIDED ON THIS
SITE ARE PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT
NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR
NON-INFRINGEMENT. In no event will ColSpace or its suppliers be liable for any indirect, special,
incidental, or consequential damages arising out of the use of or inability to use the contents of
this Site even if advised of the possibility of such damages. In no event will ColSpace or its
suppliers be liable for any damages arising from your use of the cortexpro.com Site that exceed the
amount of fees you paid for the most recent twelve months of Project CortexPro access. Some states

incidental or consequential damages, so the above limitation or exclusion may not apply to you.
